Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the Edukaka platform ("Service"), an AI-powered educational content generation tool designed for educators, teachers, tutors, and educational institutions. By accessing or using Edukaka, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. Acceptance of Terms

By creating an account, accessing, or using the Edukaka Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. User Accounts

3.1 Account Registration

To use Edukaka, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the confidentiality of your account credentials
  • Be at least 18 years old, or have parental/guardian consent if under 18
  • Maintain only one account per user

3.2 Account Security

You are responsible for all activities that occur under your account. You must immediately notify Edukaka of any unauthorized use of your account or any other breach of security.

4. Credits and Payment

4.1 Credit System

  • New users receive 20 welcome credits upon account creation
  • Credits are consumed when using AI-powered content generation features
  • Content analysis costs 2 credits per request
  • Content generation costs 10 credits per request
  • Credits are non-transferable and have no cash value

4.2 Purchasing Credits

Additional credits can be purchased securely through our payment gateway. All purchases are final and non-refundable, except as specified in our Refund Policy (Section 5).

5. Refund Policy

5.1 100% Credit Refund Policy

Edukaka offers a 100% credit refund under the following circumstances:

  • Technical Errors: If credits are deducted due to a technical error on our platform (screenshot required)
  • Content Quality Issues: If generated content is severely flawed, inappropriate, or does not match your requirements (subject to review)
  • Service Unavailability: If credits are deducted but content is not delivered due to service unavailability

5.2 Refund Process

  • Refund requests must be submitted within 7 days of the transaction
  • Requests must include a screenshot or recording of the issue
  • All refund requests are subject to verification and approval by our support team
  • Approved refunds will be credited to your account within 5-7 business days
  • Edukaka reserves the right to deny refund requests that are fraudulent or do not meet our refund criteria

6. Content and Intellectual Property

6.1 Generated Content

All AI-generated content (tests, assignments, question papers) created through Edukaka is intended for educational purposes. You retain the right to use, modify, and distribute the generated content for your teaching and educational activities.

6.2 Platform Ownership

The Edukaka platform, including all software, technology, algorithms, and AI models, is the exclusive property of Edukaka. You may not copy, modify, reverse-engineer, or create derivative works based on the platform without explicit written permission.

7. Content Retention and Data Policy

7.1 3-Month Retention Period

Generated content is retained on our servers for 90 days (3 months) from the date of creation. After this period, content is automatically deleted and cannot be recovered.

7.2 User Responsibility

  • Users are responsible for downloading and saving their generated content within the 90-day retention period
  • Edukaka is not responsible for any loss of content after the retention period expires
  • Email notifications will be sent before content expiry (if email notifications are enabled)
  • No refunds will be provided for expired content

8. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Access or attempt to access accounts, systems, or networks without authorization
  • Disrupt or interfere with the Service or servers
  • Use automated systems (bots, scrapers) to access the Service
  • Share your account credentials with others
  • Resell or redistribute generated content without proper attribution
  • Generate content that is offensive, discriminatory, or illegal

9. Service Availability and Modifications

While Edukaka strives to provide reliable and uninterrupted service, we do not guarantee that the Service will be available at all times. Edukaka reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without prior notice. Your continued use of the Service after any modifications constitutes acceptance of the modified Terms.

10. Limitation of Liability

To the maximum extent permitted by law, Edukaka shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses. Edukaka's total liability to you shall not exceed the amount you paid to Edukaka in the 12 months preceding the claim.

11. Disclaimer

The Service and all generated content are provided "as is" without warranties of any kind, either express or implied. While Edukaka uses advanced AI technology, we do not guarantee the accuracy, completeness, or suitability of generated content for your specific needs. You are responsible for reviewing and verifying all generated content before use in educational settings.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Chandigarh, India.
